CONSTITUTION AND BY-LAWS OF THE SCOUTS ROYALE BROTHERHOOD

PREAMBLE

WE, the bonafide members of the SCOUTS ROYALE BROTHERHOOD National Service Fraternity and Sorority, bound by national origin, culture, peace, tradition a common set of values and aspirations and seeking to inspire and cultivate among us the true qualities of Leadership, Friendship and Service, with the help of Almighty God, hereby promulgate this Constitution and By-laws.

Article I – NAME, TYPE OF ORGANIZATION AND SEAL

Section 1. The name of this organization shall be SCOUTS ROYALE BROTHERHOOD National Service Fraternity and Sorority or “SRB” (for brevity) and shall be referred to as the “Fraternity” in this Constitution and By-Laws.

Section 2. SRB shall be non-sectarian, non-profit and non-political. It shall be a national service fraternity.

Section 3. There shall be one common upfront seal to be used by the fraternity and all its chapters, communities, councils and alumni associations.

Section 4. There shall be one common ‘Coat Of Arms’ used by the fraternity, all its chapters, communities, councils and alumni associations.

Article II – STATEMENT OF PRINCIPLES, OBJECTIVES AND POLICIES

Section 1. The Scouts Royale Brotherhood shall advance and propagate the principles and objectives of the fraternity to humanity. Toward this end, it shall organize all members under one authority and provide for their holistic, sustaining and continuing program of growth and development.

Section 2. The Scouts Royale Brotherhood shall propagate among its members the principles of the “Three Cardinals”: To promote Leadership, To develop Friendship, and To render Service to the fraternity, community, student bodies and to the youth of the nation.

Section 3. The objectives of the fraternity shall be:

  1. To define, establish and safeguard the rights, powers and privileges of the fraternity and its members and govern its affairs;
  2. To unite all members of SRB, irrespective of race, gender, creed and color;
  3. To maintain harmonious and professional relationship among its members;
  4. To render quality service and produce law-abiding members of SRB

Section 4. The Scouts Royale Brotherhood shall endeavor to be a dynamic vehicle for growth and advancement of its members. It shall set goals, coordinate activities, and provide means of mediating controversies and disputes between and among its members.

Section 5. The Scouts Royale Brotherhood shall not engage in partisan political activity, and shall refrain from any activity that might undermine the objectives of the fraternity.

Section 6. The highest governing body of Scouts Royale Brotherhood shall be the National Council which is the symbol of solidarity and unity of goals and objectives among its members. It shall be a representative body composed of officers duly chosen and elected in a manner provided in this constitution and by-laws.

Section 7. The Scouts Royale Brotherhood shall abide by this Constitution and By-laws as the supreme governing law of the fraternity to which all other laws, orders, policies must conform and to which all its members must defer.

Article III – MEMBERSHIP, TYPES OF MEMBERSHIP

Section 1. Membership in the fraternity shall be determined as follows:

A. Full-fledged – are those members who have undergone pledgeship period and survived/passed the initiation requirement of his/her chapter or community. Pledgeship period is a process wherein a person willing to join the fraternity shall undergo a period of indoctrination, training, and wholesome initiation with regard to the ideals, principles, objectives and rules of the fraternity, and conducted in accordance with the official initiation procedure and guidelines mandated by the National Council. Full-fledged members are further classified as follows:

  1. Resident members – are those full-pledged members of SRB whose tenure in the fraternity is below seven (7) years reckoned from the date of his/her ritual rite; and
  2. Alumni Members – are those full-pledged members of SRB whose tenure in the fraternity is seven (7) years or more.
    1. Alumni members between 8-15 years tenure should mandatorily join an active Alumni Association within a District, Provincial, Municipal or City Council.

B. Royale Baby – are those child/ren born out of parents who are both full-fledged members of the fraternity and are considered as half-brother, sister until he/she has undergone and passed the minimum requirements for full-pledged membership subject to the following conditions:

  1. A Royale Baby may be welcomed to the fraternity when he/she reaches the legal age.
  2. Parents of Royale Baby/Babies may allow them to wear a Fraternity T-shirt until the age of 13. However, they are not allowed to wear Fraternity Tee-shirt/s from the age of 14 until they become Full-fledged Members.
    1. All Royale Babies should be registered with a respective chapter or community that is under the banner of Scouts Royale Brotherhood National Council.

Section 2. The following are the requirements before one can be admitted as member of the fraternity:

  1. Physically and Mentally fit. People with disability may be conferred membership provided they
  2. conform to a special screening to be determined by the Council;
  3. Satisfactorily passed the pledgeship program and other pre-membership program or requirements to be determined by the National Council;

Section 3. A rejected applicant from a chapter or community shall not be accepted by another chapter or community provided that a public notice has been announced within a District, Provincial, Municipal or City Council.

Section 4. All types of members shall be entitled to attend or participate in the affairs and activities of the fraternity at all levels. However, only the full-fledged members, full-blooded SRB and non-members of SRB-APO who are of good standing shall be entitled to vote and be voted upon. A member in good standing is one who has dutifully paid his/her dues, has control number, has actively participated in the activities of the fraternity and not otherwise serving a penalty of suspension imposed by his chapter or community.

Section 5. Membership in the fraternity may be renounced voluntarily by the member himself, such renunciation is final and irrevocable. 

Section 6. Upon the effectivity of this Constitution and By-laws, members of the fraternity who shall join APO (Alpha Phi Omega), other collegiate fraternities/sororities and gangs, will be stripped of all the privileges of the Scouts Royale Brotherhood National Service Fraternity and Sorority, give its Members which inclines handshake, attendance to gatherings, control number, wearing of fraternity tee shirt etc.”

Section 7. The Control number of an SRB member who joins APO (Alpha Phi Omega), other collegiate fraternities/sororities and gangs will automatically be voided.

Article IV – RIGHTS, PRIVILEGES, DUTIES AND OBLIGATIONS OF A MEMBER

Section 1. Members of good standing shall have the following rights and privileges:

  1. To participate in the activities of the fraternity
  2. To avail the services of the fraternity and use its facilities;
  3. To vote and to be voted upon, except those who are not entitled to vote and be voted upon pursuant to the provisions of the immediately preceding article; and
  4. To avail such other rights and privileges that may be prescribed by the National Council.

Section 2. Each member shall have the following duties and obligations:

  1. To actively participate in the activities of the fraternity;
  2. To pay the lawful dues/fees/assessments that may be required by the fraternity;
  3. To propagate the principles, objectives and ideals of the fraternity; and
  4. To act in a manner befitting a member of SRB.

Section 3. Unless otherwise increased or decreased pursuant to a resolution passed by the SRB Congress, the dues/fees to be paid by each member shall be:

  1. Membership Fee (to be paid only once)
  2. Monthly Dues at not less than Php5/day or not exceeding Php500/month or not exceeding Php6000 annually.

Section 4. The foregoing membership fee and monthly dues may be increased upon recommendation of the SRB Local/District/Provincial Council Officers and approved by the SRB Congress, provided such increase does not exceed twenty percent (20%) of the current rates.

Section 5. Upon payment of the prescribed membership fee, every member shall be entitled to the issuance of his distinct and lifetime control number.

Section 6. Ownership of a National Council ID that is valid for the current year entitles a member of the  Scouts Royale Brotherhood National Council Insurance Policy.

  1. Expiration of Scouts Royale Brotherhood National Council ID does not merit expulsion or expiration of membership from the fraternity.
  2. Insurance is only covered locally and not for international use.

Article V – GROUNDS FOR DISCIPLINARY ACTIONS, SUSPENSIONS, AND TERMINATION OF MEMBERSHIP

Section 1. The following penalties that a council, chapter or community may impose upon erring members shall be defined as follows:

  1. Disciplinary Action – is given due to the commission of petty infraction/s that a member may commit. It usually involves the reiteration of the “3 Cardinals”, “5 Duties” or the “12 Jewels” as the case may be, and upon proper deliberation of the respective officers.
  2. Suspension – is a penalty given to an erring member that involves the temporary cessation/withdrawal of the benefits and privileges of membership for a minimum period of (6) months, depending on the gravity of the offense and upon proper deliberation by its respective officers. The following infractions, when committed, shall warrant the imposition of the penalty of suspension:
    1. Failure to participate in the affairs and activities of the fraternity for a period of twelve (12) consecutive months without prior notice or valid reason;
    2. Non-payment of dues, fees and other assessments for a period of twelve (12) consecutive months without prior notice or valid reason;
    3. Gross misconduct or serious violation of the SRB constitution and by-laws, and other rules or policies promulgated by the National Council, local council and/or the chapter/community;
    4. Negligence of duty to the fraternity as a member or as an officer with regard to any duty or responsibility required and mandated by the rules or this Constitution and By-laws;
    5. Inappropriate and personal use of the fraternity’s funds;
    6. Any form of Libel/Slander against a fellow member of SRB;
    7. Entertaining/Accommodating suspended members of SRB;
    8. Physical abuse/violence committed against a fellow member of SRB; and malicious mischief;
    9. Member was caught wearing a seal/frat shirt while selling and/or using illicit/illegal drugs.
  1. Termination of Membership – is a penalty given to an erring member who is perpetually stricken-off his benefits, privileges and membership from the fraternity. Every decision rendered by a chapter/community imposing a penalty of termination shall be approved and adopted by the local council through a resolution and be furnished to the SRB Executive Officers (Disciplinary Action Coordinator and the Membership Committee) for documentation purposes. The penalty of termination of membership shall be imposed on the following infractions:
    1. Conviction by final judgment of a crime involving moral turpitude or other gross offenses which render the member unworthy of continued membership in the fraternity; Engaging in or committing acts inimical to the interest of the fraternity, or contrary to its ideals, principles and objectives;
    2. Commission of a crime against chastity against a fellow member or his/her immediate family;
    3. Commission of estafa or grave threats against a fellow member;
    4. Use of prohibited drugs during the fraternity’s gatherings, occasion or activity; and
    5. Membership in other fraternities and/or gangs whose ideals, principles and/or objectives are contrary to SRB;
    6. Three (3) instances of a suspension.

Section 4. The imposition of the penalty of suspension shall be through a resolution passed and adopted by the officers of a chapter/community upon proper deliberation by such officers whether the penalty is appropriately imposed under the circumstance, and an opportunity for the erring member to be heard. In cases of termination however, the case shall be decided by the local council.

Section 5. All impositions of the penalty of termination of membership rendered by a local council shall be appealable to the National Council. However, all decisions rendered by the National council reviewing the imposition of a penalty of termination shall be final and not appealable.

Section 6. Any doubt as to the guilt or liability of the erring member in cases of termination, shall be construed and resolved strictly against the imposition of the penalty of termination of membership.

Article VI – THE NATIONAL COUNCIL

Section 1. There shall be an institutionalized National Council of the Scouts Royale Brotherhood acting as the highest governing body of the fraternity which shall consist of the SRB Congress and SRB Executive Officers, both chosen and elected in a manner provided in this Constitution and By-laws.

Section 2. The National Council shall be convened at least twice annually (mid-year and year-end) by the SRB Congress and the SRB Executive Officers sitting jointly in a session, which shall exercise the following powers and functions:

  1. Adopt or enact regulations, policies, rules or programs for the fraternity and may create special bodies for its implementation;
  2. Formulate and adopt the annual and mid-year plan of activities of the fraternity and may create working committees for the completion and attainment of these tasks;
  3. Approve and ratify all proposals to revise the provision of the SRB Constitution and By-laws; and
  4. Exercise such other functions as it may deem proper.

Section 3. Meetings of the National Council shall be presided by the Chairman of the SRB Congress who shall not be allowed to vote except only in case of a tie.

Section 4. There shall be an SRB Congress composed of the incumbent presidents of all registered councils under the national council who shall sit its ex-officio members.

Section 5. The SRB Congress shall exercise the following powers and functions:

  1. Shall act as the policy-making body of the fraternity and exercise corporate powers thereof;
  2. shall approve through a resolution any recommendation by the SRB Executive officers for the adoption, creation, merger, division, or dissolution of a council;
  3. Shall decide on all questions of legality arising out of acts applying or implementing the CBL;
  4. Shall determine the special assessments upon the recommendation of the SRB Executive Officers;
  5. Shall approve and adopt any amendment to the SRB Constitutions and By-law;
  6. Recommend to the National Council any proposal to revise the provisions of the SRB Constitution and By-laws;
  7. Shall oversee the conduct of elections for the SRB Executive Officers through the creation of SRB Commission on Elections that is empowered to administer the qualification and election of candidates; and
  8. All other functions that may be delegated or assigned by the National Council and those which are necessary or implied from the exercise of an express power provided under this CBL.

Section 6. The members of the SRB Congress shall elect among themselves their Chairman, Vice-Chairman, and a secretary. Any member of the SRB Congress may be delegated a special task or assignment by the Chairman.

Section 7. Regular meetings of the SRB Congress shall be held at least twice annually or as often as may be called by its chairman or by any member provided sufficient notice be sent to all members at least one (1) week prior to the scheduled date of the meeting.

Section 8. Meetings of the SRB Congress shall be presided by its Chairman, or if he is absent, by the Vice-Chairman, or by any member chosen and designated to act as temporary presiding officer. In all its meetings, the rule of the majority vote shall be observed, and the presiding officer shall not vote except in case of a tie.

Section 9. There shall be a set of SRB Executive Officers which shall be the central implementing arm of the National Council who shall be elected and chosen by the registered councils of the National Council. Each registered council is entitled to one (1) vote.

Section 10. The SRB Executive Officers shall exercise the following powers and functions:

  1. Shall exercise general supervision and control over all programs, projects, services and activities of the national council and attend to the administration of the day-to-day activities of the fraternity in accordance with the policies approved by the National Council;
  2. Shall implement the approved annual plan of action adopted by the National Council;
  3. Shall prepare the fraternity budget and endorse it to the SRB Congress for approval;
  4. Shall negotiate, enter into, and sign contracts for and in behalf of the fraternity, upon authorization of the SRB Congress;
  5. Shall enforce the provisions of the CBL and other rules/directives adopted by the National Council; and
  6. Shall exercise such other functions which are necessary or implied from the exercise of an express power provided under this CBL.

Section 11. In addition to the powers and functions enumerated in the preceding section, the SRB Executive Officers shall exercise the following specific duties and responsibilities:

  1. The  President shall have the following duties and responsibilities:
  1. Act as Chief Executive Officer of the fraternity;
  2. Execute and implement the approved policies, programs and projects of the National Council;
  3. Ensure that the provisions of the SRB Constitution and By-laws are faithfully complied with and the objectives and goals of the fraternity are attained;
  4. Represent the fraternity in all contracts, agreements, acts, deeds and such other undertakings provided that prior authority is given by the SRB Congress except when such act is routinely done in nature or done in the ordinary course of business;
  5. Represent the fraternity on all public occasions and to foster respect for the principles of scouting and the constitution and by-laws;
  6. Report to the National Council whenever the latter is convened;
  7. Fill-up any and all vacancies in the SRB Executive Officers strictly observing the line of succession or to fill-up such vacancy by appointment if succession is not practicable. Such appointment does not require confirmation; and
  8. Disseminate the resolutions, directives or decisions of the National Council or the SRB Congress.
  9. The Vice-president shall have the following duties and responsibilities:
  1. Discharge the functions of the President in case the latter is temporarily incapacitated;
  2. Shall communicate with other Local Council/s and Local Chapter/s Communities and/or Alumni Association.
  3. Shall supervise and coordinate the works and activities of all instrumentalities including the committees assigned to him/her by the President;
  4. Shall provide for the protection and maintenance of the property and equipment of the fraternity;
  5. Shall communicate with other local council/s and local chapter/s; and
  6. Perform such other functions as may be assigned by the President.
  7. The Assistant Vice-President shall have the following duties and responsibilities:
  1. Shall substitute the Assistant Vice-President but will not sign or approve any laws or legal documents.
  2. Shall scout and secure ways and means for the venue/location of any Chapter/Community and/or Local Council affairs.
  3. Shall preside on the National Council meetings in the absence of the President and Vice President.
  4. Perform such other functions as may be assigned by the President.
  5. The Secretary shall have the following duties and responsibilities:
  1. Shall keep an accurate account of all proceedings and official records of the National Council and membership meetings;
  2. Shall prepare all necessary documents, certificates, contracts and other legal instruments of the fraternity;
  3. Shall send notice of meetings to the members of the national Council and the Executive Officers as may be directed by the president;
  4. Prepare the order of business of the Executive Officers and the National Council;
  5. Circularize decisions, resolutions or actions of the National Council;
  6. Act as historian of the fraternity who shall keep an accurate documentation of all the programs, activities, events and services rendered by the fraternity where such records shall form part of the fraternity’s history and archives;
  7. Shall keep an updated list of all members of the fraternity;
  8. Shall perform such additional functions as may be assigned by the President or the National Council.
  1. The Treasurer shall have the following duties and responsibilities:
  1. Shall do the safekeeping of the National Council’s fund and financial records and reports;
  2. Shall collect fees, dues, solicitations, proceeds and other financial transactions of the fraternity;
  3. Shall prepare budgets, budget estimates and financial reports to be endorsed to the SRB Congress for approval; 
  4. Shall secure SRB National Council bank account; and
  5. Shall have additional duties that may be assigned by the President.
  6. The Auditor shall have the following duties and responsibilities:
  1. Shall conduct regular audit of the funds and the properties of the fraternity;
  2. Acts as the auditor of the finances of all local councils;
  3. Shall have additional duties that may be assigned by the President.
  1. The Public Information Officer shall have the following duties and responsibilities:
  1. Shall be responsible for the publication, research or documentation of the National Council’s publication;
  2. Shall serve as the official spokesperson of the fraternity;
  3. Shall be responsible for any information released in behalf of the National Council;
  4. Shall release letter/documentations taken from the Budget and Finance Officers and the Treasurer; and
  5. Shall have additional duties that may be assigned by the President.
  6. The Budget and Finance Officer shall have the following duties and responsibilities:
  1. Shall hold the meetings on financial status of the fraternity;
  2. Shall head the fund-raising committee; and
  3. Shall have additional duties that may be assigned by the President.
  4. The Disciplinary Action Officer shall have the following duties and responsibilities.
  1. Shall monitor the behavior and conduct of officers and members of the fraternity,
  2. Shall keep a record of those whose membership was terminated pursuant to a resolution passed and adopted by a chapter/community;
  3. Shall ensure the solemnity of the meetings and the venue; and
  4. Perform such additional functions as may be assigned by the President.
  5. The Membership officer shall have the following duties and responsibilities:
  1. Shall oversee the overall growth and expansion of the membership, subject to the guidelines set by the National Council;
  2. Shall formulate and recommend wholesome program of initiation for the membership-applicants;
  3. Shall monitor the initiation rites of all local councils, chapters and communities.
  4. Shall monitor the proper execution and compliance of initiation programs in all level;
  5. Shall handle membership committee;
  6. Shall provide certification of new members; 
  7. Shall handle the releasing of members’ National ID;
  8. Shall create a vouching committee for international and local levels; and
  9. Shall have additional functions as may be assigned by the President
  10. The Recruitment Officer shall have the following duties and responsibilities:
  1. Shall supervise the screening and monitoring of the recruitment committee;
  2. Shall provide recruitment programs for local councils; and
  3. Shall have additional duties that may be assigned by the President, Vice President and Membership Officer.
  4. The Assistant Secretary shall have the following duties and responsibilities:
  1. Discharge the duties of the Secretary if the latter is temporarily incapacitated; and
  2. Perform such other functions as may be assigned by the President or Secretary.

Section 12. No member shall be eligible to hold the position of SRB Executive Officer unless he/she possesses the following qualifications on the day of his election: 

  1. Must be a member in good standing as certified by his chapter or community;
  2. Must have no legal charges or pending cases and vices as certified by the appropriate council; and
  3. Must be an alumni member as defined in this CBL and certified as such by his chapter or community.

Section 13. Regular meetings of the SRB Executive Officers shall be held at least quarterly or as often as may be called by its President.

Section 14. There shall be a designated office of the National Council upon recommendation by the SRB Congress. 

Article VII – COMMISSION ON ELECTIONS

Section 1. The Commission on Elections (COMELEC) will be headed by one Chairman.

Section 2. The Chairman will be appointed by the SRB Congress as decided upon by the NATIONAL COUNCIL from a list of possible candidates. 

Section 3. The Chairman will be assisted by Representatives from various registered councils who shall be known as the national COMELEC body. The Head will also appoint a Representative for all Local Council/s, subject for approval by the SRB Congress.

Section 4. The Chairman and members of the COMELEC should be non-partisan, full-fledged members of the NATIONAL COUNCIL in good standing, no legal charges, pending cases, and vices that may destroy the reputation of the said organization.

Section 5. The COMELEC Chairman and members are not allowed to get in touch or meet any candidate from the start of the campaign period until the declaration of,

Section 6. The COMELEC Chairman and members are not allowed to receive bribes from the candidates.

Section 7. No member of the COMELEC shall be a voting delegate, nominated to or to run for, or be a candidate to an elective office during his incumbency as such member of the COMELEC.

Section 8. If the petition is filed against the COMELEC Chairman or COMELEC Representative, the petition should be filed and addressed to the SRB Congress.

Article VIII – CHAPTERS, COMMUNITIES, LOCAL COUNCILS AND ALUMNI ASSOCIATIONS

Section 1. There shall be a Provincial Council in each province or a District Council in a city, a Municipal Council in a municipality, a City Council in a provincial city and a Chapter or Community in every local council.

Section 2. A Chapter is a section of the fraternity that is school-based while a Community is barangay-based. The following are the requirements before a Chapter or Community may be created:

  1. Must have at least fifteen (15) full-fledged members currently enrolled in the school or actually residing in the barangay, as the case may be;
  1. That there is no existing chapter in a school or community in a barangay;
  2. Must submit to the Local Council a petition for creation of a Chapter/Community which shall include:
    1. Letter requesting for recognition;
    2. Services rendered by the petitioning chapter/community;
    3. Roster of members
    4. History; 
    5. Duly accomplished Registration Form; and
    6. Payment of registration fee upon approval of the local/district/provincial council for newly registered chapters.

Section 3. Upon compliance of the above-cited requirements, the application shall be approved by the Local Council through a resolution passed for such purpose. However, in cases where there is no existing local council within the locality, a petition for recognition may be filed directly to the SRB Executive Officers through its Membership Officer.

Section 4. A Chapter or Community shall be headed by its own set of executive officers who shall be elected at large by the members in their respective chapter/community jurisdiction and shall be composed of the following: 

  1. A Grand Chancellor (President) who shall have the following duties and functions:
  1. Act as the Chief Executive officer of the chapter or community;
  2. Call and preside over the meetings of his chapter/community and vote only in case of a tie;
  3. Create special committees for specific purposes;
  4. Exercise general supervision over the affairs and properties of the chapter/community;
  5. Shall sign or countersign all certificates, contracts and other instruments of the chapter/community;
  6. Shall represent the chapter/community in all its public functions or occasions and foster respect for the principles of scouting;
  7. Shall assist in the implementation or enforcement of orders, directives and rules or regulations adopted by the Local Council or the National Council; and
  8. Shall serve as the principal resource of the National Council or Local Council for data, information, methods, evaluations and systems;
  9. A Prime Chancellor (Vice President) who shall have the following duties and functions:
  1. Shall discharge the functions of the Grand Chancellor (President) if the latter is incapacitated. However, he shall not be allowed to sign or approve any order, directive or regulation in cases where the discharge of functions were temporary in nature;
  2. Shall serve as the external relation officer;
  3. Shall communicate with other chapter/community; and
  4. Shall discharge such other functions as may be assigned by the Grand Chancellor.
  5. An Assistant Prime Chancellor (Assistant Vice President) who shall have the following duties and functions:
  1. Shall conduct regular audit of the funds and properties of the chapter/community;
  2. Shall hold meetings on financial status of the chapter/community;
  3. Shall lead the fund-raising initiative of the chapter/community;
  4. Shall discharge the functions of the Prime Chancellor if latter is temporarily incapacitated;
  5. Shall discharge such other functions as may be assigned by the Grand Chancellor.
  6. A Brother Historian (Master Initiator) who shall have the following duties and functions:
  1. Shall implement and supervise the proper execution of the initiation programs for member-applicants of the chapter/community;
  2. Shall provide certification of new members;
  3. Shall supervise the screening and monitoring of the recruitment committee;
  4. Shall lead the membership committee; and
  5. Shall discharge such other functions as may be assigned by the Grand Chancellor.
  6. A Brother Prefect (Disciplinary Action Coordinator) who shall have the following duties and functions:
  1. Shall monitor the behavior and conduct of officers and members of the Chapter/Community;
  2. Shall initiate and execute the proper disciplinary actions to officers and members who committed infractions as defined under Article V of this Constitution and By-laws;
  3. Shall ensure the solemnity of the meetings and the venue of the meeting and ensure that proper decorum is observed during the meeting; and
  4. Shall discharge such other functions as may be assigned by the Grand Chancellor.
  5. A Scribe (Secretary) who shall have the following duties and functions:
  1. Shall record and keep an accurate account of all proceedings of the chapter/community;
  2. Shall prepare all necessary documents, certificates, contracts and other instruments of the chapter/community;
  3. Shall prepare the needed notices for the meeting and caused the distribution thereof to officers and members;
  4. Shall read the minutes of the previous meetings and certify to its correctness;
  5. Shall be the historian of the chapter/community and cause the proper documentation of all programs, activities, events and services undertaken by the chapter/community. Such records shall become part of the history archives;
  6. Shall keep and update a roster of membership of the chapter/community; and
  7. Shall discharge additional functions as may be assigned by the Grand Chancellor.
  1. A Keeper of Treasury (Treasurer) who shall have the following duties and responsibilities:
  1. Shall be responsible for the safekeeping of the chapter/community funds and financial records/reports;
  2. Shall collect lawful fees, dues, solicitations, proceeds and other financial transaction of the chapter/community;
  3. Shall prepare budget, budget estimates and financial reports subject to the approval by the Grand Chancellor;
  4. Shall assist the Assistant Prime Chancellor in fund raising activities or plans; and
  5. Shall discharge such other functions as may be assigned by the Grand Chancellor.

Section 5. A Chapter or Community shall exercise autonomy in the exercise of its powers and functions and may adopt its own rules and regulations not inconsistent with the SRB Constitution and By-laws and orders or directives issued by the national and local council.

Section 6. That chapter names released by NC shouldn’t be used by ex-members that have changed allegiance from Scouts Royale Brotherhood National Council to SRB Inc.

Section 7. There shall be created a Provincial or District Council if the following requirements are met:

  1. A written petition by at least three (3) recognized Chapters or Communities which shall state among others the following:
    1. The copy of the resolutions recognizing the creation of the petitioning chapter/community;
    2. Updated membership roster of each petitioning chapter/community;
    3. History;
    4. An attached endorsement letter by the Alumni Association of the province or city concerned; and
    5. Duly accomplished Registration Form; and
  2. The creation of a District Council must not diminish the minimum requirements established for any existing provincial council;

Section 8. The Local Council thus created shall have the following set of officers who shall be elected at large within their respective councils:

  1. A Grand Chancellor (President) who shall have the following duties and responsibilities:
  1. Act as the chief executive officer of the council;
  2. Represent the council in the SRB Congress as an Ex Officio member;
  3. Enforce SRB Constitution and By-laws and other Orders, Rules or Directives adopted by the council;
  4. Preside over the meetings of the council and shall vote only in the case of a tie;
  5. Create special working committees and appoint or designate its chairman and members;
  6. Exercise direct control and supervision over the officers of the different chapter/community;
  7. Sign or counter-sign all certificates, contracts or other instruments issued or entered into by the council;
  8. Represent the council in all public occasions or gatherings and/or communications, and to sign or counter-sign all contracts, agreements, deeds and other similar undertakings entered into by the council;
  9. Perform such other functions which are necessary and may be implied from the exercise of an express power mandated under this Constitution and By-laws.
  1. A Prime Chancellor (Vice President)t who shall have the following duties and responsibilities:
  1. Discharge the functions of the Grand Chancellor in case the latter is temporarily or permanently incapacitated;
  2. Assist the Grand Chancellor in supervising the affairs of its member-chapter or community and shall personally direct the implementation of programs and projects downloaded to each chapter or community; and
  3. Perform such other functions as may be assigned by the Grand Chancellor.
  4. An Auxiliary Prime Chancellor (Assistant Vice-president) who shall have the following duties and responsibilities:
  1. Exercise control and supervision over all Master Initiators of the different Chapters and Communities under council;
  2. Supervise the proper execution of all membership programs of the different Chapters and Communities under the council;
  3. Conduct regular audit of the funds and properties held by the council; and
  4. Perform such other functions as may be assigned by the Grand Chancellor.
  5. A Scribe (Secretary) who shall have the following duties and responsibilities:
  1. Certify members of the fraternity who are of good standing;
  2. Record the minutes of the meeting and keep an archive of such proceedings;
  3. Act as Chairman of the Rostering Committee empowered to update the roster of members and assign control numbers to new members through a convenient but secured process of data gathering and recording;
  4. Exercise direct control and supervision over all elected Secretaries of the Chapter or Community under the council;
  5. Prepare the order of business of every meeting and send notices of such meetings;
  6. Keep an archive of orders, issuances or directives formulated and passed/adopted by the national or local council and by the chapters/communities under its jurisdiction;
  7. Act as historian of the fraternity keeping a record of all the programs, activities, events and services conducted in pursuit of its goals and objectives;
  8. Perform such other functions as may be assigned by the Grand Chancellor.
  9. A Keeper of Treasury (Treasurer) who shall have the following duties and responsibilities:
  1. Keep the funds, properties, financial records and reports of the fraternity for safekeeping;
  2. Sign and issue receipts of expenses or disbursements of the fraternity dues;
  3. Apply, keep and maintain a savings bank account in the name of the fraternity, with the Grand Chancellor as co-signatory;
  4. Collect and receive membership fees and other lawful dues and apply the same to the prescribe allocation in accordance with the provisions of this Constitution and By-laws or other rules;
  5. Monitor and exercise supervision over the Chapter and Community Treasurers;
  6. Act as the chairman of the Committee on Solicitations and other fund-raising activities of the fraternity; and
  7. Perform such other functions as may be assigned by the Grand Chancellor.
  8. A Brother Prefect (Disciplinary Action Coordinator) who shall have the following duties and responsibilities
  1. Monitor the behavior and conducts of officers and members of the fraternity;
  2. Initiate and execute the proper disciplinary actions to officers and members who have violated the laws or have done misconducts;
  3. Ensure the solemnity of the meetings and the meeting place and see to it that proper decorum is observed during meetings;
  4. Handle the membership committee;
  5. Recommend to the President the conduct of special meeting to review the decision rendered by a chapter/community concerning the imposition of a penalty of termination to an erring member;
  6. Perform such other functions as may be assigned by the Grand Chancellor.
  7. A Brother Herald (Public Relations Officer) who shall have the following duties and responsibilities:
  1. Responsible for the building of the image of the fraternity, in print, radio and other\ social media;
  2. Establish rapport with the media;
  3. Publish and manage the fraternity newsletter;
  4. Issue press releases upon approval of the Grand Chancellor;
  5. Monitor and exercise supervision over the Chapter/Community PRO’s; and
  6. Perform such other functions as may be assigned by the Grand Chancellor.

Section 9. The following requirements shall be observed as minimum continuing qualifications for all positions in the local council:

  1. Must be an Alumni member of the SRB and possesses of a control number;
  2. Must be a member in good standing as certified by Council Secretary and attested by the Chapter/Community Treasurer;
  3. Must actually reside within the territorial jurisdiction of the Council; and
  4. Must not have been convicted by final judgment of any offense involving moral turpitude or otherwise imprisoned.

Section 10. There shall be a Municipal Council created in a Municipality or a City Council in a City within a province if the following requirements are met:

  1. A written petition by at least three (3) recognized Chapters or Communities which shall state among others the following:
  1. The copy of the resolutions recognizing the creation of the petitioning chapter/community;
  2. Updated membership roster of each petitioning chapter/community;
  3. History;
  4. An attached endorsement letter by the Alumni Association of the province or city concerned; and
  5. Duly accomplished Registration Form; and
  6. The creation of a Municipal Council must not diminish the minimum requirements established for any existing city councils;

Section 11. The Municipal Council / City Council thus created shall have the following set of officers who shall be elected at large within their respective Municipal councils /  City councils.

  1. A Prime Chancellor (Vice-president) who shall have the following duties and responsibilities:
    1. Assist the Provincial Council Grand Chancellor (President) in supervising the affairs of its chapter or community and shall personally direct the implementation of programs and projects downloaded to each chapter or community; and
    2. Perform such other functions as may be assigned by the Provincial Council Grand Chancellor (President).
  2. A Scribe (Secretary) who shall have the following duties and responsibilities:
    1. Certify members of the fraternity who are of good standing;
    2. Record the minutes of the meeting and keep an archive of such proceedings;
    3. Act as Chairman of the Rostering Committee empowered to update the roster of members and assign control numbers to new members through a convenient but secured process of data gathering and recording;

    5. Monitor and exercise supervision over the Chapter and Community Treasurers;
    6. Act as the chairman of the Committee on Solicitations and other fund-raising activities of the fraternity; and
    7. Perform such other functions as may be assigned by the Provincial Council Grand Chancellor (President).

Section 12. The officers of the council shall serve for a term of three (3) years and shall be eligible of being re-elected indefinitely for the same position except in the case of a Grand Chancellor (President) who shall be absolutely disqualified to serve such position for more than a single term. Voluntary renunciation of the position at any time shall not be considered as an interruption in the continuity of his term for which he was elected.

  1. An impeached officer shall not be eligible to run for office at any time in the future.

Section 13. The Officers of the Councils, Chapters and Alumni Associations shall serve for a term of three (3) years and shall be eligible of being re-elected indefinitely for the same position except in the case of a President who shall be absolutely disqualified to serve such position for a succeeding term. Voluntary renunciation of the position at any time shall not be considered as an interruption in the continuity of his term for which he was elected.

Section 14. Any vacancy arising in the Council shall be filled by observing the line of succession. However, if succession is not practicable, vacancy shall be filled through an appointment by the Council President without a need of confirmation.

Section 15. There shall be created in every province/city or abroad, an Alumni Association who shall be mandated to foster the attainment of the following objectives:

  1. Promote the aims and ideals of the fraternity as spelled-out in this Constitution and By-laws and orders, directives, policies and regulations adopted by the National Council;
  2. Advise, assist and participate actively in the formulation and implementation of a Council or Chapter/Community programs, projects or activities;
  3. Establish a sense of camaraderie and fraternal affections among resident and alumni members of the fraternity;
  4. Maintain an active and working network of alumni members in promoting the Cardinal
  5. Principles and as an essential partner of the council; and
  6. Do such other acts or things as are conducive or incidental to the attainment of these objectives.

Section 16. All Alumni Association shall comply with the following requirements before being recognized:

  1. A Letter of Intent seeking recognition which shall include to state among others:
  1. List of at least fifteen (15) Alumni members actually residing within the province/city or stationed abroad and individual members’ certificate of “Good Standing” issued by their respective Council/Chapter/Community Secretary;
  2. A set of officers duly elected for the purpose of seeking recognition; and
  3. History;
  4. Only one (1) official Alumni Association shall be created in every council. However, in cases of alumni associations abroad, a state/country may have two (2) or more alumni associations provided they are considerably separated by regions and that there will be no confusion in identities.

Section 17. Every Alumni Association shall elect among themselves a Chairman, a Vice-chairman, a Secretary, a Treasurer and a Public Relations Officer and other positions that it may deem necessary to effectively carry-out its mandated objectives.

Section 18. Pursuant to Section 8 of this Article, all Alumni in a Chapter or Community may organize themselves into an Alumni Association having the same calling in the exercise of the same profession.

Section 19. Pursuant to guidelines adopted by the National Council, there shall be created an\ International Affairs Committee empowered to assist the SRB executive officers in coordinating to function in international affairs and grievances of Alumni Association and/or members outside of the country.

Article IX – MECHANICS OF RECALL

Section 1. All elected officers of the National Council, the local council, the Chapter/Community and the Alumni Associations may be recalled from office for loss of confidence at any time during their term, provided that no initiative for recall shall be allowed within six (6) months from the assumption of office or within the same period from the time of last recall.

Section 2. A power of recall shall be deemed instituted through the filing of a written petition with the President/Chairman, duly signed by at least a majority (50% + 1) of:

  1. Registered Local Councils if the officer sought to be recalled is an officer of the SRB Congress or of the SRB Executive Officers;
  2. All incumbent officers of all registered Chapters/Communities if the officer sought to be recalled is a Local Council Officer;
  3. Full-fledged members in good standing if the officer sought to be recalled is a Chapter/Community Officer; and
  4. Alumni members in good standing if the officer sought to be recalled is an officer of the Alumni Association.

Section 3. After the petition is duly filed, the petitioners shall convene a special body tasked to perform the following specific powers:

  1. Choose among themselves who will act as Chairman, a Vice-chairman and a Secretary;
  2. Notify the officer who is the subject of the recall proceeding, of the fact that a petition for recall has been instituted against him;
  3. Set a schedule for election which shall be held not earlier than twenty (20) days nor later than thirty (30) days following the filing of the petition;
  4. Within five (5) days following the filing of the petition, cause to publicize for a period of at least fifteen (15) days the conduct of recall proceedings which shall include among others:
  1. the name and position of the officer/s sought to be recalled;
  2. The name/s of the nominee/s and the position sought to be elected for;
  3. The time and place where the election is to be conducted;
  4. The scheduled date of the election; and
  5. Such other information that may facilitate the proceeding.
  1. Supervise the conduct of a transparent election through the utilization of practicable means to ensure a more transparent but expeditious system of recall and election; and
  2. Proclaim the winning candidates through a resolution adopting the results of the election.

Section 4. A recall of an officer shall be effective only upon the election and proclamation of a successor in the person of the candidate receiving the highest number of votes cast during the election on recall. Should the officer sought to be recalled receive the highest number of votes, confidence in him is hereby affirmed and shall continue in office.

Section 5. A petition for recall may be defeated by a contrary petition timely filed at any time before an election-recall is conducted, affirming the confidence reposed upon the officer, duly signed by at least two-thirds (2/3) of the total membership who initiated the petition for recall. The same petition for recall shall also be considered as withdrawn if after the lapse of thirty (30) days from the filing of the petition, no successor has been proclaimed.

Section 6. Any proclaimed winning candidate who succeeded the recalled officer shall serve only the remainder of the term of his predecessor. Such succession shall not be considered as election to a full term of office.

Article X – IMPEACHMENT

Section 1. There shall be official grounds for officers to be impeached which may fall under the following offenses:

  1. Gross misconduct or serious violation of the SRB constitution and by-laws, and other rules or policies promulgated by the National Council, local council and/or the chapter/community;
  2. Negligence of duty to the fraternity as a member or as an officer with regard to any duty or responsibility required and mandated by the rules or this Constitution and By-laws;
  3. Inappropriate and personal use of the fraternity’s funds;
  4. Any form of Libel/Slander against a fellow member of SRB;
  5. Entertaining/Accommodating suspended members of SRB;
  6. Physical abuse/violence committed against a fellow member of SRB; and malicious mischief
  7. Conviction by final judgment of a crime involving moral turpitude or other gross offenses which render the member unworthy of continued membership in the fraternity; 
  8. Engaging in or committing acts inimical to the interest of the fraternity, or contrary to its ideals, principles and objectives;
  9. Commission of a crime against chastity against a fellow member or his/her immediate family;
  10. Commission of estafa or grave threats against a fellow member;
  11. Use of prohibited drugs during the fraternity’s gatherings, occasion or activity; and
  12. Membership in other fraternity whose ideals, principles and/or objectives are contrary to SRB

ARTICLE XI – GENERAL PROVISIONS

Section 1. The rules on the computation of a quorum of the fraternity shall be as follows:

  1. For the National Council, majority (50% + 1) of the SRB Congress membership including its Chairman or Vice-chairman plus (+) the majority of the incumbent SRB Executive Officers;
  2. For the SRB Congress, the presence of at least a majority of the registered council-member;
  3. For the SRB Executive Officers, (50% + 1) members including the President or the Vice-President shall constitute a quorum;
  4. For the Local Council, four (4) members including the President or the Vice-president shall constitute a quorum;
  5. For the Chapter or Community, five (5) members including the Grand Chancellor or the Prime\ Chancellor, and the Master Initiator shall constitute a quorum; and
  6. For the Alumni Association, the presence of at least a majority of the total membership or fifteen (15) alumni members, whichever is lower shall constitute a quorum.

Section 2. The following allocation of fund shall be observed:

  1. The collected membership fees shall be allocated as follows:
    1. Forty percent (40%) of which shall inure to the National Council;
    2. Forty percent (40%) shall inure to the Local Council; and
    3. Twenty percent (20%) of which shall be kept as general fund of the chapter or community.
  2. The monthly dues collected by each chapter or community shall be allocated as follows:
    1. Ten percent (10%) shall go to the National Council;
    2. Ten percent (10%) shall go to the Local Council; and
    3. Eighty percent (80%) shall be kept by the Chapter/Community as its general fund.

Section 3. Every Chapter, Community or Council shall be allowed at their discretion to register the fraternity with any institution or organs of the government of the Republic of the Philippines provided the following policies shall be strictly observed and complied with:

  1. That the registration with any government institution shall be approved by at least a majority of its members through a resolution passed for the said purpose and furnished the National Council;
  2. That it shall have a separate Constitution and By-laws and shall not use the provisions of the SRB CBL pertaining to salient details regarding the composition, structure, rights and privileges and the principles, objectives and policies of the fraternity;
  3. That the distinct and separate constitution and by-laws shall not provide for a general membership and shall respect the position of non-conforming members of the fraternity;
  4. That it shall undertake to explain to the members of the fraternity that the registration of the fraternity as another organization with any government institution necessarily implies the vesture of a separate and distinct personality apart from the fraternity;
  5. That it shall not use the duly registered organization as representing the fraternity itself nor shall it be made to represent the fraternity in any communication or public/fraternal functions; and that the purpose of registration shall be for convenience alone.

Section 4. In accordance to a policy that the National Council may adopt, the fraternity shall undertake to establish a chapter/community abroad provided the following requirements are observed and complied with:

  1. There shall be a registered alumni association who shall initiate the first recruits;
  2. That these recruits were all nationals of the country where the chapter/community shall be created;
  3. Election of their own set of officers;
  4. The alumni association shall act as an advisory council to the officers and facilitate for the registration with the national council; and
  5. Any existing chapter/community abroad at the time of the ratification of this Constitution and By-laws, shall be required to register with the National Council provided it has complied with requirement under subsections B and C of this section.

Section 5. All members of Scouts Royale Brotherhood National Council who sell SRB merchandise should register their business with the National Council.

  1. A member that sells SRB merchandise shall provide (2%) to Scouts Royale Brotherhood National Council per project.

Article XII – AMENDMENTS TO THE CONSTITUTION

Section 1. Any amendment to or revision of this Constitution and By-laws may be proposed by any registered Chapter or Community duly endorsed by its Local Council and submitted to the SRB Congress for proper action.

Section 2. Any proposed amendment of this Constitution and By-laws shall be approved by a two-thirds (2/3) vote of all the members of the SRB Congress.

Section 3. Any proposed revision of this Constitution and By-laws shall be approved and ratified by a majority vote of those present in a National Convention duly called for the purpose.

Section 4. Any amendment or revision shall take effect upon its approval, unless a specific date has been determined.

Article XIII – TRANSITORY PROVISIONS

Section 1. For purposes of synchronization, all Local Councils shall elect their new set of officers on or before September 22, 2027 whose term shall end on the same date three (3) years thereafter.

Section 2. A regular election for the SRB Executive Officers shall be called on the last Saturday of November every after three (3) years.

Article XIV- REPEALING CLAUSE

Section 1. All executive orders, directives that are inconsistent with the provisions of this amendment are hereby superseded and repelled.

Article XV – EFFECTIVITY

Section 1. This Constitution and By-laws and all amendments thereto shall take effect this 5th day of May 2024.
